Terms of Service

Please read these Terms of Service carefully before using CritSheet. By creating an account or using the service, you agree to be bound by these terms. If you do not agree, do not use CritSheet.

1. About CritSheet

CritSheet is a software-as-a-service platform operated by Trevor Brown ("CritSheet," "we," "us," or "our") that helps Dungeon Masters track D&D session statistics, manage campaign data, and generate AI-powered session recaps and prep notes. These Terms govern your access to and use of critsheet.io and any related services (collectively, "the Service").

2. User Accounts

To create campaigns and log sessions, you must create an account. You must be at least 13 years of age to use CritSheet. If you are under 18, you represent that you have your parent or guardian's permission.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at hello@critsheet.io if you believe your account has been compromised.

You may not share, sell, or transfer your account to another person.

3. Subscriptions and Billing

CritSheet offers a free tier and paid subscription plans. Paid plans are billed on a recurring monthly basis and will automatically renew each billing cycle until cancelled.

Cancellation. You may cancel your subscription at any time through the billing portal at /settings/billing. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused time in a billing period.

Payment processing. All payments are processed by Stripe, Inc. By providing payment information, you authorize Stripe to charge your payment method on a recurring basis. We do not store your full card number. Stripe's use of your payment data is governed by Stripe's Privacy Policy.

Price changes. We may change subscription prices with at least 30 days' advance notice. Your continued use of the Service after a price change takes effect constitutes acceptance of the new price.

4. Audio Recordings and AI Processing

This section is important. Please read it carefully before uploading any audio.

CritSheet allows you to upload audio recordings of your game sessions for automated transcription and AI-powered stat extraction. When you upload audio:

  • Your audio is transmitted to AssemblyAI for transcription using speaker diarization technology. AssemblyAI may create voice-derived features (including speaker identification data) during processing.
  • The resulting transcript is transmitted to Anthropic for AI analysis and stat extraction.
  • Your audio and transcript data are not used to train AI models by CritSheet, AssemblyAI, or Anthropic under their standard API terms.

Consent responsibility. By uploading a recording, you represent and warrant that:

  • You have obtained the informed consent of all individuals whose voices appear in the recording before uploading it to CritSheet.
  • You have the right to upload the recording and to authorize its processing by CritSheet and our third-party service providers.
  • Your upload does not violate any applicable law, including laws governing wiretapping, eavesdropping, biometric data collection, or recording consent.

CritSheet is not responsible for any claims arising from your failure to obtain proper consent from all parties recorded. You agree to indemnify and hold CritSheet harmless from any claims, damages, or costs related to unauthorized recording or processing of third-party voices.

5. User Content

You retain ownership of all campaign data, session stats, player information, audio recordings, and other content you create or upload ("Your Content").

By using CritSheet, you grant us a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely to provide the Service to you.

We may use aggregated, anonymized data (with no personally identifiable information) for product analytics and improvement. We do not sell Your Content to third parties.

6. Public Content

Box scores, player profiles (character names and stats only — never real player names), and campaign leaderboards are publicly accessible by design. Sharing is a core feature of CritSheet. By saving a session, you acknowledge that the session data will be viewable by anyone with the link. Do not include sensitive personal information in fields intended for public display.

7. AI Features and Accuracy

CritSheet uses artificial intelligence to transcribe audio and extract session statistics. AI-extracted data may contain errors and should always be reviewed before being saved. AI-generated content (summaries, pre-session briefs, awards) is provided as a convenience tool. CritSheet makes no guarantees about the accuracy or fitness of AI-generated content for any particular purpose.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable law
  • Upload content you do not have the right to share or process
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Interfere with or disrupt the integrity or performance of the Service
  • Scrape, crawl, or extract data from the Service by automated means without written permission
  • Impersonate any person or entity
  • Use the Service to harass, abuse, or harm any individual

9. Third-Party Services

CritSheet relies on third-party services including Supabase, AssemblyAI, Anthropic, Stripe, Vercel, and Sentry. We are not responsible for the availability, performance, or security of these services.

Your use of third-party services integrated with CritSheet may be subject to their own terms and privacy policies.

10. Service Availability

CritSheet is provided "as is" without any guarantee of uptime or availability. We reserve the right to modify, suspend, or discontinue the Service at any time. We will make reasonable efforts to preserve user data, but cannot guarantee against data loss.

11. Disclaimers

CritSheet is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that any AI-generated output will be accurate.

12. Limitation of Liability

To the maximum extent permitted by law, CritSheet's total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) $50 or (b) the amount you paid CritSheet in the 12 months preceding the claim.

In no event shall CritSheet be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — even if advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless Trevor Brown (operating as CritSheet) from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, your violation of any third party's rights, or your failure to obtain appropriate consent for any audio recordings you upload.

14. Termination

You may close your account at any time by contacting us at hello@critsheet.io. Your data will be retained for up to 30 days following account closure to allow for any final exports before permanent deletion.

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Sections covering IP, disclaimers, limitation of liability, and indemnification survive termination.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Iowa, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Iowa, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15a. Iowa Consumer Data Protection Act (Iowa CDPA)

Iowa residents have additional rights under the Iowa Consumer Data Protection Act (Iowa Code ch. 715D), effective January 1, 2025:

  • The right to confirm whether we are processing your personal data
  • The right to access personal data we have collected about you
  • The right to delete personal data you have provided to us
  • The right to obtain a portable copy of personal data you have provided
  • The right to opt out of the sale of your personal data (CritSheet does not sell personal data)

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above. For material changes, we will make reasonable efforts to notify you by email or through the Service before the change takes effect. Continued use after the effective date constitutes acceptance of the revised Terms.
